if i have a mental disorder which makes me go violent, will i get away with a murder?

by MasterBlaster on September 3, 2010

i have read it in wikipedia, that it will be considered as mental disorder defense. i am just checking it here, to see if the information i read was correct.

let’s say, i have a mental disorder and someone is slandering me for no apparent reason without any fact. if i shoot the person in the head in response, will i be in trouble?

what do you think?
just to let you know, i am not planning anything serious. i am just curious about what will happen if a person with a disorder commits a crime.

Yes, you are conscious of the disorder and you did nothing to avoid the situation. Even if you can use it as a defense, it is not a total defense, it is merely a mitigating factor.

You have just admitted through your wording that you know murder is wrong. Since you know murder is wrong and a crime an insanity defense would not hold up in court. Plus if you did, since you have been researching it you would probably be charged with 1st degree murder b/c inquiries like this shows premeditation.

hahaha you believe wikipedia? ANYONE can go on there and change what it says

No you will not get a way with murder.

There was a guy here he was 18. He was mentally challenged. Stuck in a wheel chair. He could barely talk and he could move his arms. He shot his dad and killed him and he was charged with murder.

Depends on where you live, in Texas the mentally challenged can get the death penalty just as fast as normal people.

only your own.

No, you would get tryed for insanity and most likely thrown in a crazy house.

The fact that you asked the question will be enough for any forensic psychologist/psychiatrist to find that you knew right from wrong. Being mentally ill does automatically excuse one from committing a crime.
I think that you will be in trouble. Big time.

In canada your lawyer could argue that you were mentally unstable. Technically you wouldn’t be charged with murder, but you would have to do at least 30 days being evaluated by a forensic psychiatrist. If you are not declared mentally unstable, you will be charged with murder, if you are you will then move on to a mental hospital and you will have to stay there. After being treated, usually the judge still orders you to finish your time in jail.

You will be in trouble. They will lock you up with the criminals or with the loonies. Either way you’ll be locked up.

By asking the question you do not have a mental disorder. You are proving that you have the power of reason and manipulation. If you have a mental disorder you will still be held accountable and receive the same sentence as any other criminal. If you are found to be insane, (and you are not) you could be found innocent and still be incarcerated for the rest of your life with the criminally insane. You could also avoid execution this way, but still spend the rest of your life in prison. Most people in jail have a disorder. Not caring what is right or wrong.

No, you won’t get away with anything because you’re already imprisoned in and by your own mind. Will you be in trouble? Yes. Can you be held responsible? Maybe not… but there are cases where very mentally troubled people were held accountable for their actions because they knew the difference between right and wrong. Not every mentally ill person gets away with murder. Mental illness is not an automatic “Get Out Of Jail Free” card.

A well known defense which the courts in any modern country are well aware of and capable of testing. Would you like to live the remainder of your life in a nut house or a jail house, both are prisons.

You’re too funny…take a look at good ol’ Charles Manson…he’s as loony as they come…and exactly where has he been living for the last couple of decades? In a little 6 x 6 cell.
